Christmas Mini Session Terms & Conditions
Suitability
Each mini photo session is designed for between 1 – 3 siblings and an individual family photo if desired. Babies should ideally be able to sit unaided unless you or an older sibling are happy to also be in the photo for support.
Timing
Sessions are short and mini! Please arrive on time to ensure that you receive the full time allowed for your session. Please DO NOT arrive before your session as this may disrupt the previous clients photoshoot.
Styling & Images
Props similar to those seen in the advertisement are provided. Some clothing will be available but not guaranteed for each size so to avoid disappointment please bring suitable clothes for your child.
The Photographer will select 5 images to edit from the session. The photographer’s judgment regarding which images to edit shall be deemed correct. Images will be fully hand edited and finished in line with the style seen in the advert on the photographers website and social media applications. No pose or expression can be guaranteed as every child is different. Clients will receive 5 files via digital download within 2 weeks of your session. Unedited files will not be available. If the client has purchased a fantasy image this will be provided in addition to the 5 images.
Payment
Payment and acceptance of these terms and conditions is required to complete your booking. This secures your mini shoot date and time and is nonrefundable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Discounts are not eligible to be redeemed against mini sessions due to the already discounted price.
Cancellation
The Client may cancel this contract at any time by giving written notice to The Photographer but in doing so shall forfeit any monies paid. If the client needs to change the date of a photo shoot once
agreed then any new date or time will be subject to the Photographer’s availability.
The client is allowed to transfer the booking to another family however the session itself must not change in type, date or time.
Responsibilities
The photographer will always use the highest standard of care when working with the client’s children but responsibility for their child/ren will remain with the client at all times.
Behind the Scenes photography
Clients are not permitted to bring camera equipment to the photo session and any behind the scenes photos must be taken with the explicit consent of the photographer at all times. Furthermore, images taken in this way must be shared with the photographer only and are not permitted in the public domain without the photographers written consent.
Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken
to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
Attendance
In the unlikely event of the Photographer being unable to attend the photo shoot due to unforeseen circumstances, they will initially try to reschedule the session for the earliest possible date but reserve the
right to cancel the session and refund your booking fee in full.
Copyright and Use of images
The copyright Designs and Patents Acts assign the copyright of the images to the photographer. The copyright and all other rights in the Photos shall be retained by Victoria Theaker, trading as Victoria Nixon
Photography (the “Photographer”). The Photographer asserts the right to be credited as the author of the Photos in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction of any Photos will constitute a breach of copyright and legal action will be taken.
The Client understands that any images purchased are for personal use only and cannot be used for commercial purposes without explicit consent of and credit to the photographer.
The photographer uses social media to provide clients with a sneak peak of their images prior to the editing being complete. It is also important for the photographer to use their images to create a portfolio
of work that enables clients to decide if they like the style of photography as the client(s) did on his occassion before booking the photographer. Unless advised otherwise in writing, the client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, albums, leaflets, postcards, galleries and photography competitions etc.
Liability
Our entire liability for any breach of this Agreement or any representation, act or omission (including negligence) shall be limited to our fee in relation to the Photo Services and we shall not be responsible for any special, indirect or consequential or pure economic loss, costs, damages, charges or expenses. The limitation on liability shall also apply in the event that Photos are lost through equipment malfunction, are lost in the mail or otherwise lost or damaged where the Photographer is not liable.
Privacy
I take your privacy seriously and will not pass your contact information for marketing purposes to any other organisations. I will contact you from time to time to inform you of any offers that may interest you in
relation to the work we have done together but you can opt out at any time by emailing me at [email protected]
General
These Terms and Conditions constitute the whole Agreement between the parties and supersede all previous agreements between the parties relating to its subject matter. This Agreement and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the law of England and Wales.
